Frequently Asked Questions

Helpful answers to questions we regularly hear from clients across Ontario.

How much severance pay am I entitled to in Ontario?
Severance depends on age, position, length of service, compensation, availability of similar work, and the terms of your employment agreement. Many employees are offered less than they may be entitled to receive.
Can I be fired without cause in Ontario?
Yes. An employer can terminate without cause if proper notice, severance pay, or compensation in lieu of notice is provided. The termination still has to comply with Ontario employment law and any valid contract terms.
What should I do before accepting a severance package?
Do not sign before understanding what you are giving up. Once a release is signed, you may lose the ability to pursue more severance or challenge unfair terms later.
Can I be fired while on medical leave or disability leave?
An employer cannot fire you simply because you need medical leave or disability accommodation. If you were dismissed while sick, injured, or on leave, employment and human rights issues may be involved.
What should I do if my long-term disability claim is denied?
Review the denial letter carefully before appealing. LTD insurers often deny claims based on medical evidence, policy wording, surveillance, or return-to-work opinions. Legal advice can help protect the claim before the next response is sent.
Why did my insurance company cut off my LTD benefits?
Benefits may be cut off because the insurer says you no longer meet the disability definition, can return to work, failed to provide enough medical support, or did not satisfy a policy requirement.
Can LTD benefits be stopped after two years?
Yes. Many LTD policies change after two years from an own occupation test to a broader any occupation test. This is a common point where insurers terminate benefits or demand more medical and work-capacity evidence.
Do I need a lawyer for a long-term disability appeal?
It is smart to get legal advice before filing an LTD appeal. Repeating the same medical records may not fix the denial, and missed deadlines or weak appeal wording can hurt the claim.
What is workplace discrimination in Ontario?
Workplace discrimination can involve unfair treatment based on disability, race, sex, age, religion, family status, or another protected ground under the Ontario Human Rights Code.
Does Lutfi Law Firm offer free consultations for LTD and employment matters?
Yes. Lutfi Law Firm offers free consultations for long-term disability claims, employment law disputes, severance reviews, wrongful dismissal, workplace discrimination, and related Ontario legal matters.
